Overview
This Service Agreement is between MapCrush Reviews, a service of MapCrush Local, and the business signing below ("Client"). MapCrush provides Google review generation and management services designed to increase Client's volume of genuine customer reviews, improve Client's average star rating over time, and support review response management.
Term
All plans include an initial 14-day free trial. After the trial, billing begins automatically at the rate for the plan selected above unless cancelled beforehand. Plans are month-to-month and renew automatically each billing cycle.
What's Included
- Review request campaign setup (SMS and/or email, personalized by customer name)
- Customer database review request sends and/or NFC/QR review card program
- MapCrush responds to your incoming Google reviews on your behalf, and provides monthly review monitoring, alerting, and a performance report
- One meal donated to Feeding America for every review received
Compliance
All reviews generated are solicited exclusively from Client's real past or current customers — never fake, incentivized-for-content, or gated reviews. Client represents that any customer list provided was collected lawfully and Client has a reasonable basis to contact those individuals. MapCrush honors all opt-out (STOP) requests immediately.
Cancellation
Client may cancel at any time effective at the end of the current billing cycle by providing written notice. Payments already made are non-refundable, as they cover work performed and in progress. Trial-period cancellations before day 14 are not billed.
Customer Data Handling
Any customer contact list Client provides (names, phone numbers, and/or emails) is used solely to execute Client's review request campaign and is not sold, shared, or used for any other purpose. MapCrush stores this data securely and will delete or return it upon written request or termination of this Agreement.
Mutual Indemnification (TCPA/A2P Compliance)
Client represents and warrants that any customer list provided to MapCrush was lawfully collected and that Client has a good-faith, existing business relationship with each contact, sufficient to permit SMS/email outreach under applicable law (including TCPA). Client agrees to indemnify and hold MapCrush harmless from any claim, fine, or legal action arising from Client providing an inaccurate, unlawful, or non-consented contact list. MapCrush agrees to indemnify Client for claims arising solely from MapCrush's own failure to execute the campaign in a compliant manner (e.g., ignoring a valid opt-out request).
25-Review Guarantee
If Client's business does not receive 25 new honest Google reviews within the first 14 days of active outreach, MapCrush will continue working at no additional charge until that milestone is reached. This guarantee applies only to businesses that provide a customer contact list of 250 or more contacts with valid cell phone numbers available for SMS outreach. Results depend on contact list quality and customer response rates. The guarantee does not apply if Client fails to provide adequate contact information, cancels service before the milestone is reached, or violates this Agreement.
No Guarantee of Google's Platform Behavior
Google controls whether reviews are published, displayed, or removed, and can suspend or restrict any Business Profile at its own discretion. MapCrush is not responsible for reviews removed by Google, algorithm changes, or profile actions taken by Google that are outside MapCrush's control.
Late Payment
If a scheduled payment fails after the free trial ends, MapCrush will attempt to charge the payment method on file for up to 5 business days. If payment cannot be collected within that window, MapCrush may pause the review campaign until payment is resolved.
Limitation of Liability & Governing Law
MapCrush's total liability under this Agreement is limited to the amount Client paid MapCrush in the 3 months preceding any claim. MapCrush is not liable for indirect, incidental, or consequential damages, including lost profits. This Agreement is governed by the laws of the State of California, and any disputes shall be resolved in the courts of Orange County, California.
