These Terms of Service ("Terms") govern your use of the MapCrush Reviews service and website at mapcrushreviews.com, operated by MapCrush Reviews ("MapCrush," "we," "our," or "us"). By signing up for, accessing, or using our service, you agree to be bound by these Terms.
Please read these Terms carefully before starting your free trial or subscribing to our service.
1. Service Description
MapCrush Reviews is a Google review management service that helps local businesses generate authentic reviews from their past and current customers. Our service includes:
- Personalized SMS and/or email outreach to your customer list requesting honest Google reviews.
- Automated professional responses to reviews you receive on your Google Business Profile.
- Regular progress reporting on review count, star rating growth, and profile performance.
- Optional NFC tap card fulfillment for in-person review collection (additional fees may apply).
All reviews generated through our service come exclusively from real customers of your business. We do not create, fabricate, or incentivize fake reviews.
2. Free Trial
We offer a 14-day free trial for new clients. During the trial period:
- No charge is applied to your payment method for 14 days from enrollment.
- Full service begins upon receipt of your customer contact list and completion of setup.
- If you cancel before day 15, you owe nothing and your card will not be charged.
- If you do not cancel before day 15, your subscription automatically converts to the plan you selected at signup — Starter ($97/month), Growth ($147/month), or Pro ($247/month) — and your payment method on file is charged.
3. Subscription & Pricing
After the free trial, the service is offered on a monthly subscription basis at one of three plan levels: Starter ($97/month), Growth ($147/month), or Pro ($247/month), based on the plan selected at signup. Billing occurs automatically on the same date each month. All prices are in U.S. dollars. You may upgrade or downgrade your plan at any time, effective the following billing cycle.
We reserve the right to adjust pricing with 30 days' advance notice to active subscribers. Your continued use of the service after a price change constitutes acceptance of the new pricing.
4. 25-Review Guarantee
We offer a results guarantee under the following conditions:
- If your business does not receive 25 new honest Google reviews within the first 14 days of active outreach, we will continue working at no additional charge until you reach that milestone.
- This guarantee applies only to businesses that provide a customer contact list of 250 or more contacts with valid cell phone numbers available for SMS outreach.
- Results are dependent on contact list quality, customer response rates, and other factors outside our control.
- The guarantee does not apply if the client fails to provide adequate contact information, cancels service before the milestone is reached, or violates these Terms.
5. Client Responsibilities
By using our service, you agree to:
- Provide accurate and complete business information during onboarding.
- Grant MapCrush Reviews manager-level access to your Google Business Profile for the purpose of responding to reviews.
- Provide customer contact lists containing only legitimate past or current customers of your business.
- Ensure you have appropriate legal authority and consent to allow us to contact your customers via SMS and/or email on your behalf.
- Comply with all applicable laws, including the TCPA, CAN-SPAM Act, and any applicable state and local regulations.
- Not use our service to solicit reviews in exchange for incentives, discounts, or payment (in violation of Google's review policies).
6. TCPA & Compliance
You represent and warrant that you have a prior business relationship with every contact on any list you provide to us, and that you have obtained all necessary consents required under the Telephone Consumer Protection Act (TCPA) and any other applicable law for us to send SMS messages on your behalf. You agree to indemnify and hold MapCrush Reviews harmless from any claims, fines, or penalties arising from your failure to obtain proper consents.
7. Cancellation Policy
You may cancel your subscription at any time by contacting us at hello@mapcrushlocal.com or calling (714) 507-1717.
- Cancellations take effect at the end of the current billing period. You will not be charged for the following month.
- No refunds are issued for the current billing month if you cancel mid-cycle. You retain access to service through the end of your paid period.
- If MapCrush Reviews terminates your account for reasons unrelated to a breach of these Terms or non-payment, a prorated refund of the current month's fee may be issued at our discretion.
- If you cancel during the free trial period (before day 15), no charge is applied.
8. Prohibited Uses
You may not use our service to:
- Contact individuals who have not had a genuine business relationship with you.
- Generate reviews for businesses you do not own or have authority to represent.
- Solicit fake, fabricated, or incentivized reviews.
- Violate any applicable laws, Google's Terms of Service, or any platform's review policies.
- Harass, spam, or improperly contact any individual.
9. Intellectual Property
All content on mapcrushreviews.com — including text, graphics, logos, and service materials — is the property of MapCrush Reviews and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.
10. Limitation of Liability
To the maximum extent permitted by law, MapCrush Reviews and its owners, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our service, including but not limited to loss of revenue, loss of business, or loss of data.
Our total liability to you for any claim arising from the use of our service shall not exceed the total fees paid by you in the 3 months preceding the claim.
11. Disclaimer of Warranties
Our service is provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, reliability, or availability of our service, or that our service will meet your specific business needs. Review volume and business outcomes vary and are not guaranteed beyond the terms of our 25-review guarantee stated in Section 4.
12. Indemnification
You agree to defend, indemnify, and hold harmless MapCrush Reviews, and its owners, agents, and employees from any claims, damages, fines, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the service, (b) your violation of these Terms, (c) your failure to obtain required customer consents, or (d) your violation of any applicable law.
13. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We may update these Terms from time to time. We will notify active subscribers of material changes via email at least 14 days before changes take effect. Continued use of our service after the effective date of updated Terms constitutes acceptance of those changes.
